1) Scope

1.1 These General Terms and Conditions (hereinafter "GTC") of GRNK GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller with regard to the goods presented by the Seller in its online store. The inclusion of the Customer’s own terms is hereby objected to, unless otherwise agreed.

1.2 These GTC apply accordingly to contracts for the delivery of vouchers, unless expressly stated otherwise.

1.3 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

1.4 An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade or self-employed professional activity.


2) Conclusion of Contract

2.1 The product descriptions contained in the Seller’s online store do not constitute binding offers on the part of the Seller but serve to enable the Customer to submit a binding offer.

2.2 The Customer can submit the offer via the online order form integrated into the Seller’s online store. By clicking the button concluding the ordering process, the Customer submits a legally binding contractual offer regarding the goods in the shopping cart.

2.3 The Seller may accept the Customer’s offer within five days:

  • by sending the Customer a written or electronic order confirmation (email or fax),

  • by delivering the ordered goods, or

  • by requesting payment from the Customer after the order is placed.

If several of these alternatives apply, the contract is concluded when the first of these events occurs. The period for acceptance begins on the day after the offer is sent by the Customer and ends at the end of the fifth day thereafter. If the Seller does not accept the offer within this period, the offer is deemed rejected.

2.4 If PayPal is selected as the payment method, payment processing is handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, subject to PayPal’s terms and conditions (https://www.paypal.com/de/webapps/mpp/ua/useragreement-full) or, if the Customer does not have a PayPal account, the terms for payments without a PayPal account (https://www.paypal.com/de/webapps/mpp/ua/privacywax-full). If the Customer uses a PayPal method during checkout, the Seller declares acceptance of the offer at the moment the Customer clicks the order completion button.

2.5 If “Amazon Payments” is selected, payment is processed via Amazon Payments Europe s.c.a., Luxembourg, under the terms at https://payments.amazon.de/help/201751590. The Seller accepts the Customer’s offer upon initiation of the Amazon payment process.

2.6 When ordering via the Seller’s online form, the contract text is stored and sent to the Customer after the order is placed. If the Customer has a user account, order data is stored there.

2.7 Before submitting the order, the Customer can identify and correct errors using the browser’s magnification function and the usual keyboard and mouse controls until clicking the final order button.

2.8 The contract language is German.

2.9 Order processing and communication usually take place via email. The Customer must ensure their email address is correct and that Seller emails can be received.


3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Further details are provided in the Seller’s Instructions on Withdrawal.


4) Prices and Payment Terms

4.1 Unless otherwise stated, prices include VAT. Additional shipping costs are shown separately.

4.2 For deliveries outside the EU, additional costs such as bank transfer fees, currency conversion fees, import duties, or taxes (e.g., customs duties) may apply and are borne by the Customer.

4.3 Available payment methods are specified in the online store.

4.4 If “SOFORT” is selected, payment is processed via SOFORT GmbH, Munich (https://www.klarna.com/sofort/).

4.5 If “Shopify Payments” is selected, processing is via Stripe Payments Europe Ltd., Dublin, Ireland (https://www.shopify.com/legal/terms-payments-de).

4.6 If “Stripe” is selected, processing is via Stripe Payments Europe Ltd., Dublin, Ireland (https://stripe.com/de).

4.7 For credit card payments via Stripe, the invoice amount is due immediately upon contract conclusion. Stripe may conduct a credit check.

4.8 If “Klarna” is selected, payment is processed by Klarna Bank AB, Sweden (https://grnk.shop/pages/zahlungsmoglichkeit-klarna).


5) Delivery and Shipping Terms

5.1 Delivery is made to the shipping address specified by the Customer.

5.2 If delivery fails due to reasons attributable to the Customer, they bear the resulting costs.

5.3 Risk passes to the Customer upon handover of goods to the carrier if the Customer arranged the carrier.

5.4 The Seller may withdraw from the contract in case of non-delivery by suppliers.

5.5 Self-collection is not possible.

5.6 Vouchers are provided via email.


6) Retention of Title

Goods remain the Seller’s property until full payment is received.


7) Liability for Defects (Warranty)

7.1 For entrepreneurs, warranty claims for new goods expire one year after delivery; for used goods, they are excluded.

7.2 Exclusions do not apply to damages, fraudulent concealment, goods used for construction, or obligations to provide updates.

7.3 Entrepreneurs’ statutory recourse claims remain unaffected.

7.4 Merchants must comply with inspection and notification obligations under § 377 HGB.

7.5 Consumers should report transport damage to the carrier, but failure to do so does not affect claims.


8) Liability

8.1 The Seller is fully liable for intent, gross negligence, injury to life, body, or health, guarantees, and mandatory legal liability (e.g., product liability).

8.2 For negligent breaches of essential contractual obligations, liability is limited to foreseeable, typical damages.

8.3 Otherwise, liability is excluded.

8.4 The above also applies to agents and legal representatives.


9) Redemption of Gift Vouchers

9.1 Gift vouchers can be redeemed only in the Seller’s online store.

9.2 They are valid for three years after purchase.

9.3 They must be redeemed before completing the order; later redemption is not possible.

9.4 Multiple vouchers may be used per order.

9.5 Vouchers cannot be used to purchase other vouchers.

9.6 If the voucher value is insufficient, another payment method must be used for the balance.

9.7 No cash payout or interest.

9.8 Vouchers are transferable, except where the Seller is aware of unauthorized use.


10) Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.


11) Place of Jurisdiction

For merchants or legal entities under public law, the Seller’s registered office is the exclusive place of jurisdiction.


12) Alternative Dispute Resolution

12.2 The Seller is neither obliged nor willing to participate in dispute resolution before a consumer arbitration board.
